These Terms of Service (the "Terms") govern your use of the Global Air Scandinavia website at globalairscandinavia.com, the online account, the booking and flight-search tools, the loyalty programme registration, the support assistant and any other digital services we make available through the website (together, the "Services").

Global Air Scandinavia is a planned Nordic airline that is preparing for launch. Some parts of the website — most visibly the booking flow — are presented as a preview of how the airline will operate and do not yet issue tickets or take payment. Where that is the case we say so on the relevant page, and these Terms explain what it means for you.

By using the Services you agree to these Terms. If you do not agree with them, please do not use the website.

About these Terms

In these Terms, "Global Air", "we", "us" and "our" refer to Global Air Scandinavia, operated by [AIRLINE LEGAL NAME], [REGISTERED ADDRESS]. "You" means any person who visits the website or uses the Services, whether or not you hold an online account.

The Terms apply to the website, to the account you may create on it, to flight searches and reservations made through it, to registration for the Global Air loyalty programme, and to any communication you have with us through the site, including the support assistant.

When Global Air begins commercial operations, carriage on our flights will be subject to our Conditions of Carriage and to the fare rules attached to each ticket. Those documents will be published on the website before tickets go on sale. If a term in the Conditions of Carriage or a fare rule conflicts with these Terms in relation to a specific flight, the Conditions of Carriage or fare rule takes precedence for that flight.

Nothing in these Terms limits any right you have under consumer-protection or passenger-rights legislation that cannot be excluded or limited by agreement.

Eligibility and your responsibilities

You may create an account or make a reservation only if you are able to enter into a binding contract under the law that applies to you. If you make a reservation on behalf of another person, you confirm that you have that person's authority to do so and that you have brought these Terms to their attention.

Much of what we do depends on the information you give us being right. You are responsible for:

  • providing accurate, current and complete passenger details, including names exactly as they appear on the travel document that will be used for the journey;
  • keeping your login credentials confidential and not sharing your account with anyone else;
  • telling us promptly at the address in section 24 if you believe your account has been accessed without your permission;
  • using the website only for lawful purposes and in the way it is intended to be used;
  • not interfering with the operation of the website, its security features or the systems that support it;
  • not attempting to gain access to areas of the website, other users' accounts or data that you are not authorised to see, including the investor information area, which is restricted to invited parties;
  • not using the booking or loyalty tools to make speculative, duplicate or fraudulent reservations or registrations; and
  • not submitting false information to us.

Accounts are protected by a password and by a one-time verification code sent to your email address when you sign in. You are responsible for anything done through your account until you tell us it has been compromised.

Flight bookings and reservations

Current status of the booking tool

Until Global Air opens for sale, the booking flow on the website is a demonstration. It shows how a search, passenger details, seat selection, extras, safety acknowledgements and payment will work. It does not create a reservation, issue a ticket or charge a payment method, and any booking reference it displays is illustrative only. The flow asks you to acknowledge this before you complete it.

When bookings open

Once ticket sales begin, the following will apply to reservations made through the website.

  • All flights are subject to availability. A fare shown in search results is not guaranteed until the reservation is confirmed.
  • A reservation is confirmed when we have accepted your payment and sent a confirmation with a booking reference to the email address you provided. Please check the confirmation carefully and contact us straight away if anything is wrong.
  • You are responsible for the accuracy of the passenger details you enter. Corrections may be possible before departure but can be subject to the fare rules and to a charge, and some corrections — for example a change of passenger — may not be permitted at all.
  • Changes to dates, routes or passengers, and cancellations, are governed by the fare rules that apply to your ticket. Some fares are non-changeable or non-refundable; the rules are shown before you pay.
  • If you do not check in or board a flight you have booked and have not cancelled it in accordance with the fare rules, the fare may be forfeited and any onward or return segments may be cancelled.
  • Seat selection, meals, additional baggage, priority boarding and similar extras are optional services. They are subject to their own conditions and to availability on the day, and where an extra cannot be provided for operational reasons we will refund the amount paid for it.
  • Special requests (for example assistance or specific dietary needs) should be made as early as possible, and in any case within the notice periods published on the website. See also section 10.

Specific fare rules and conditions attached to an individual ticket form part of your contract of carriage for that journey and may differ from the general description above.

Fares, taxes and fees

The price of a ticket may be made up of several components: the base fare, government taxes, airport and security charges, any carrier-imposed surcharges, service fees for the booking channel used, and charges for optional extras you choose. The website itemises these components before you are asked to pay.

The total price displayed at the payment stage is the price that applies to that booking. Displayed prices in search results and at earlier steps may change before that point, for example because the fare class sells out or because a tax or charge is updated by the authority that sets it.

If a price is displayed incorrectly because of an obvious error — for example a fare of a few kroner for an intercontinental flight — we may cancel the booking and refund what you paid, or offer you the correct price. We will contact you before doing either.

Prices are shown in the currency indicated on the page. Your card issuer may apply its own exchange rate and fees; see section 5.

Payment

No payment is taken through the website while the booking tool is in demonstration mode. The card fields in the preview are not connected to a payment processor, and we ask you not to enter real card details into them.

When paid bookings become available, payment will be handled by a third-party payment processor rather than by Global Air itself. The following will apply.

  • We will state at the time of booking which payment methods are accepted for a given fare and currency.
  • By submitting payment details you authorise us and our payment processor to charge the full amount shown, and to carry out the checks needed to verify the payment and prevent fraud. A booking may be cancelled if verification fails or if the payment is later reversed by the card issuer.
  • If a transaction fails, no reservation is created and any temporary hold placed by your card issuer is released in the normal course.
  • If you believe you have been charged twice for the same booking, contact us with both transaction references and we will investigate and refund any duplicate charge.
  • Where your card is issued in a currency other than the one used for the booking, the amount you see on your statement may differ from the price displayed because of your issuer's exchange rate and any fees it applies. We have no control over these.
  • Payment details are entered on pages served by our payment processor or transmitted directly to it. Global Air does not store full payment-card numbers or security codes on its own systems.

The payment processor's own terms and privacy notice apply to its handling of your payment information.

Tickets and travel documents

The name on a ticket must match the name on the passport or other travel document you will present at the airport. Airlines are generally not permitted to carry a passenger whose ticket name does not match their document, so please check every name before you confirm a booking.

It is your responsibility to hold, and to present when asked, all documents required for your journey. Depending on the route, that may include a valid passport with sufficient remaining validity, visas or electronic travel authorisations for the destination and for any transit country, entry permits, proof of onward travel, and any health documentation that the destination requires at the time of travel.

Global Air does not determine whether you will be admitted to a country. Entry decisions are made by the authorities of that country. We may refuse to carry a passenger who does not have the documents the destination or transit state requires, and we may be obliged to pass on fines or costs imposed on us as a result of a passenger travelling without the correct documents, to the extent the applicable law and Conditions of Carriage allow.

Requirements change, sometimes at short notice. We recommend checking the official sources for your destination shortly before you travel.

Changes, cancellations and disruptions

Airline schedules are planned months in advance and are occasionally affected by events on the day. A flight may be retimed, delayed, rerouted or cancelled because of, among other things:

  • schedule changes made after your booking, for example to aircraft rotation or slot allocation;
  • weather at the departure, arrival or alternate airport;
  • air traffic control restrictions or airspace closures;
  • airport restrictions, closures or capacity limits;
  • security incidents or threats;
  • government or regulatory requirements;
  • technical or operational issues affecting the aircraft or crew; or
  • other circumstances outside our reasonable control, as described in section 19.

If your flight is changed or cancelled we will tell you using the contact details on your booking as soon as we reasonably can, and we will explain the options available to you. Depending on the circumstances those may include re-routing on the next available Global Air flight, a refund, or other remedies.

Your rights when a flight is delayed, cancelled or overbooked, including any right to care, re-routing, refund or compensation, depend on the law that applies to your itinerary and on the cause of the disruption. Those rights are set by legislation and by our Conditions of Carriage, and nothing in these Terms reduces them. Where mandatory passenger-rights rules apply to your flight, we will comply with them.

Times shown in timetables and on your booking are not guaranteed and do not form part of the contract of carriage, other than as required by applicable law.

Check-in and boarding

Where online check-in is offered for your flight, you will be able to check in through the website or account area within the window published for that route. Airport check-in will remain available for passengers who cannot or prefer not to check in online, and for passengers whose documents need to be verified in person.

Check-in and boarding-gate deadlines vary by airport and route. The current deadlines are published in the check-in and boarding information on the website and on your booking confirmation. If you arrive after a deadline has passed we may not be able to accept you for the flight, and the fare rules for your ticket will determine what happens to your booking.

You must present valid identification and the travel documents required for your journey at check-in and at the gate. We may decline to board a passenger where that is necessary for safety, security or legal reasons, where the passenger does not hold the required documents, or where the passenger's conduct is likely to endanger or disturb others. Any such decision is made in accordance with our Conditions of Carriage and applicable law.

Baggage

Baggage allowances differ according to the fare purchased, the route, the aircraft operating the flight and, in some cases, your loyalty tier. The allowance that applies to your booking is shown before you pay and on your booking confirmation. General guidance on allowances is also published on the website and may be updated from time to time.

  • Checked baggage: pieces, weight and dimensions are limited to the allowance for your fare. Baggage above the allowance may be accepted as excess baggage on payment of the applicable charge, subject to space on the aircraft.
  • Cabin baggage: size and weight limits apply for safety reasons and so that bags fit in the overhead lockers or under the seat. Cabin bags that exceed the limits may need to be checked in, which may incur a charge.
  • Restricted and dangerous items: certain items may not be carried at all, and others may be carried only in checked or only in cabin baggage. The booking flow asks you to confirm that you are not carrying dangerous goods. The current list of restricted items is published on the website and is based on international dangerous-goods regulations.

If your checked baggage is delayed, damaged or lost, report it to our staff or handling agent at the airport before you leave the baggage hall, and in any event within the time limits set out in the Conditions of Carriage and applicable law. Our liability for baggage is governed by the international conventions that apply to your journey and by our Conditions of Carriage.

Special assistance and accessibility

We want travel with Global Air to be workable for everyone. Passengers who need assistance — for example because of reduced mobility, a sensory or cognitive impairment, a medical condition, or because they are travelling with a service animal or medical equipment — can request it when booking or afterwards through the contact details in section 24.

Some forms of assistance require arrangements with the airport, our handling agents or the aircraft operator. So that we can put those arrangements in place, we ask that requests are made in advance, within the notice period published on the website. Requests made later will still be considered, and we will do what we reasonably can on the day.

For certain medical conditions we may ask for information from a doctor to confirm that it is safe for you to fly, or to arrange oxygen or other support. Any health information you give us for this purpose is handled as described in our Privacy Policy.

Assistance for passengers with disabilities or reduced mobility is provided in accordance with the accessibility legislation that applies to the flight and the airports concerned.

Loyalty programme

Global Air operates a loyalty programme that is currently in a pre-launch registration phase. Signing up on the website expresses your interest and reserves a place as a founding member; it does not yet accrue points, miles or benefits, and the tiers and benefits described on the Loyalty page show what we plan to offer rather than what is available today.

When the programme launches, membership will be governed by separate programme rules published on the website. Those rules will cover how points or status are earned and redeemed, how long they remain valid, how tiers are assessed, and the circumstances in which an account or benefits may be adjusted or withdrawn. If the programme rules conflict with these Terms in relation to the programme, the programme rules apply.

Membership is personal to you and may not be sold or transferred. We may correct a loyalty account where points or status have been credited in error or obtained in breach of the rules.

Website content and intellectual property

The Global Air name, logo, aircraft livery, wordmark and the design of the website are the property of Global Air or are used under licence. The text, graphics, photographs, video, software, page layouts and other material on the website are protected by copyright, trade-mark and other intellectual-property laws.

You may view the website and print or download pages for your own personal, non-commercial use — for example to keep a copy of a booking or of these Terms. You may not otherwise copy, reproduce, republish, distribute, modify, create derivative works from, or commercially exploit any part of the website without our prior written permission or that of the relevant rights holder.

Some material on the website belongs to third parties and is displayed with their permission or under licence, including certain stock photographs and map imagery. Global Air does not claim ownership of that material, and your use of it is subject to the rights holder's terms.

If you believe content on the website infringes your rights, please contact us using the details in section 24.

Prohibited conduct

To keep the website working properly for everyone, you must not:

  • use the website to commit fraud or to make bookings or registrations you do not intend to honour;
  • use automated tools to scrape fares, content or data from the website, other than search engines indexing publicly available pages in accordance with our robots directives;
  • attempt to access accounts, systems or data without authorisation, or probe or test the vulnerability of our systems without our written consent;
  • introduce viruses, malware or other harmful code, or take any action that imposes an unreasonable load on our infrastructure;
  • interfere with, disrupt or circumvent the security or booking-integrity features of the website;
  • impersonate another person, misrepresent your relationship with anyone, or provide false identity or payment information;
  • use the support assistant to send abusive, threatening or unlawful content; or
  • use the website in any way that breaks the law or infringes anyone's rights.

If we reasonably believe you have engaged in conduct of this kind we may take the steps described in section 15, and we may report the matter to the relevant authorities where appropriate.

Suspension or termination

We may restrict, suspend or close your online account, or block access to some or all of the website, if you materially breach these Terms, if we are required to do so by law, if we reasonably suspect fraud or misuse, or if we need to do so to protect the security of the website or of other users. Where reasonable we will tell you why, and give you an opportunity to respond.

You may close your account at any time by contacting us. Closing your account does not cancel any confirmed booking; bookings continue to be governed by their fare rules and the Conditions of Carriage.

Suspension or closure of an account does not affect any right you have under applicable law, including in relation to bookings you have paid for or refunds you are owed, and does not affect any provision of these Terms that by its nature is intended to survive, such as sections 12, 16 to 20 and 22.

Disclaimers

We take reasonable care to keep the information on the website accurate and up to date, but airline information changes frequently and we cannot promise that every page is complete or current at every moment. Timetables, route maps, fleet and cabin descriptions, and loyalty-programme details describe our plans and may change before or after launch. Where information on the website conflicts with your booking confirmation or with the Conditions of Carriage, the confirmation and Conditions of Carriage prevail.

The website is provided on an "as available" basis. We do not guarantee that it will be available without interruption, that it will be free from errors, or that any defect will be corrected within a particular time. Maintenance, updates and events outside our control can make the website temporarily unavailable.

The support assistant on the website provides general information to help you find your way around. Its answers are not a substitute for the information in your booking, in the Conditions of Carriage or from our customer-service team, and it cannot make or change bookings.

These disclaimers do not exclude or limit any warranty or right that cannot be excluded or limited under applicable law.

Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. Nor do these Terms limit our liability as an air carrier for the carriage of passengers and baggage, which is governed by the international conventions that apply to your journey, by applicable passenger-rights legislation and by our Conditions of Carriage.

Subject to the paragraph above, and to the extent permitted by applicable law, we are not liable for loss that was not a foreseeable result of our breach of these Terms, for loss arising from your use of the website for business purposes, or for loss caused by events outside our reasonable control as described in section 19.

Where you are a consumer, you may have statutory rights and remedies that these Terms do not affect. The limitations in this section apply only to the extent that they are permitted by the law that protects you.

Indemnification

If you use the website in breach of these Terms or in breach of applicable law — for example by making fraudulent bookings, attempting unauthorised access, or infringing someone else's rights — and Global Air suffers loss, or a claim is brought against Global Air as a result, you agree to compensate us for the reasonable losses, costs and expenses we incur because of that conduct.

This section does not apply to the extent the loss was caused by our own breach or negligence, and it does not affect any right you have under consumer-protection law.

Events beyond reasonable control

Neither you nor Global Air will be in breach of these Terms for a delay or failure to perform that is caused by an event beyond the affected party's reasonable control. For an airline, such events include severe weather, volcanic ash, natural disasters, epidemics and public-health measures, air traffic control restrictions or strikes, airport closures, government orders and regulatory action, security incidents and threats, war or civil unrest, industrial action affecting us or our suppliers, failures of third-party infrastructure such as telecommunications or fuel supply, and unforeseen technical faults that could not reasonably have been prevented.

If such an event affects a flight, the options and rights described in section 7 apply. Where mandatory passenger-rights rules provide for care, re-routing or refunds regardless of the cause of a disruption, those rules continue to apply and this section does not limit them.

Governing law and jurisdiction

These Terms, and any dispute arising out of or in connection with them or with your use of the website, are governed by the law of [GOVERNING LAW / JURISDICTION TO BE CONFIRMED], and the courts of that jurisdiction have non-exclusive jurisdiction over such disputes.

If you are a consumer, you also benefit from any mandatory provisions of the law of the country in which you live, and you may bring proceedings in the courts of that country where that law allows. Contracts of carriage for individual flights may be subject to the international conventions and passenger-rights legislation that apply to the route flown, as set out in the Conditions of Carriage.

If you have a complaint, please raise it with us first using the contact details in section 24 so that we can try to resolve it directly. Where a dispute cannot be resolved, you may be entitled to refer it to an alternative dispute-resolution body or to the national enforcement body for passenger rights in the relevant country.

Changes to these Terms

We may revise these Terms from time to time, for example to reflect the start of commercial operations, new features on the website, changes in the law or lessons from how the website is used. The current version is always available on this page, and the "Last updated" date at the top shows when it was most recently changed.

Changes apply from the date they are published. If a change is material we will take reasonable steps to bring it to your attention, for example by notice on the website or by email to account holders. Bookings made before a change takes effect continue to be governed by the version of the Terms, fare rules and Conditions of Carriage in force when the booking was made, unless the law requires otherwise.

Severability

Each provision of these Terms operates separately. If a court or competent authority decides that any provision is unlawful, invalid or unenforceable, that provision will be treated as amended to the minimum extent necessary to make it enforceable, or, if that is not possible, removed. The remaining provisions continue in full force.

Entire agreement

These Terms, together with our Privacy Policy, and — for any flight you book — the applicable fare rules and Conditions of Carriage, form the whole agreement between you and Global Air about your use of the website and Services. They replace any earlier terms published on the website. Nothing in this section limits liability for fraud or excludes statutory rights that cannot be excluded.

If we do not enforce a provision of these Terms on one occasion, that does not mean we have waived it or that we cannot enforce it later.
